This application is distributed by Cellularline SpA, having its registered office in Reggio Emilia, via G. Lambrakis 1/A, VAT number 09800730963 and registration number in the Reggio Emilia Commercial Register no. RE315329; Tel. O522 334002.
This Privacy Policy applies only to the processing of personal data resulting from the use of the mobile application “ION WEAR” and not to the collection and processing of data carried out through different channels.
The main function of the App is to allow, via Bluetooth technology, the connection between smartwatch “ION EDGE” and the user's smartphone, to allow the configuration of the Product, the management of its functionality and the display of data relating to physical activity and well-being.
1. ROLE OF CELLULARLINE
Cellularline SpA acts as Data Controller in accordance with Regulation (EU) 2016/679 (GDPR) in relation to the processing of personal data related to the distribution of the App and the management of the features made available by it. The App is designed according to an architecture that favors data control exclusively by the user, through data storage mainly on the user's smartwatch and/or mobile device.
2. PURPOSE OF THE APP AND NATURE OF THE TREATMENT
The App “ION WEAR” allows the connection between smartwatches and the user's smartphone via Bluetooth technology, to display data related to physical activity and well-being, to configure and manage wearable device settings, enable notifications and device control features, and allow local consultation of data recorded by the device.
Cellularline SpA does not collect, store or access the personal data of the user on its own servers or of third parties. In particular:
• the data generated by the smartwatch is stored exclusively on the user's mobile device;
• no transmission of biometric, healthcare or activity data to cloud systems managed by Cellularline is carried out;
• no user account is created;
Cellularline is unable to identify, access or process user data through the App
2.1 TYPE OF DATA PROCESSED
All data is processed exclusively on the user's device and includes:
• Activity and well-being data: Steps and physical activity, distances walked, calories consumed, heart rate, oxygen saturation (SpO₂), sleep values, training and recovery parameters, etc.
• Body data entered by the user: Height, weight, age, sex
• Derived data: Physical fitness indicators (e.g. stress, body age, fitness score), sleep quality analysis, activity and performance statistics
• Data processed via mobile device functionality: Some App features may require access to user device resources, including: Bluetooth, device sensors (e.g. step count, if available), notifications, location (where configured for GPS functionality)
Data processing occurs exclusively for the execution of the device's functionality and in relation to the preferences, configurations and permissions and the authorized functions in your device.
The App and Product enable the local display and processing of information related to physical activity and well-being, which, by their nature, can have a high degree of sensitivity and deserve particular attention from the user when managing the permissions and settings of their device. It is recalled that the Product is intended for fitness, wellness and personal monitoring activities only and does not constitute a medical device, nor is it intended for the diagnosis, prevention, monitoring, treatment or cure of diseases or clinical conditions. The information displayed by the App is for informational purposes only and should in no case replace the opinion, diagnosis or indications of qualified healthcare professionals.
3. TRANSMISSION OF DATA TO THIRD PARTIES
Cellularline does NOT in any case transmit the personal data processed by the App to third parties.
At the user's request, the App can instead allow synchronization with optional external services, such as Apple Health, Google Health Connect, or similar services. In such cases, the transfer takes place on the initiative and under the direct control of the user, the consequent processing taking place in accordance with the methods and conditions of the respective providers (to whose privacy policy we refer); such services may involve the transfer of data to countries outside the European Economic Area (EEA), including the United States or China (the guarantees applicable to such transfers are those defined by the respective suppliers); Cellularline has no control over the activity of such third parties on the data so transmitted.
4. DATA RETENTION
I dati sono conservati esclusivamente sul dispositivo dell’utente. Cellularline non definisce né impone un termine massimo di conservazione, in quanto non ha accesso ai dati. L’utente è l’unico soggetto che determina la durata della conservazione, potendo eliminare dati tramite le funzionalità dell’App, o disinstallare l’App. Attenzione: la disinstallazione dell’App comporta la cancellazione e la perdita definitiva di tutti i dati memorizzati localmente.
5. RIGHTS OF THE DATA SUBJECT
Since Cellularline SpA does not have access to data stored locally on the user's device, the practical exercise of many of the rights provided for in Articles 15–22 GDPR (such as access, rectification, cancellation and portability) occurs directly through the functionality of the App and the device used. All rights recognized by the applicable legislation and the possibility of contacting Cellularline at the contact details indicated in this notice remain unaffected.
The user, moreover, always holds the right to lodge a complaint with the competent Personal Data Protection Authority. In Italy: Guarantor for the Protection of Personal Data (www.gpdp.it).
6. WAY OF DATA PROCESSING AND SECURITY
The App is designed to ensure Bluetooth communications are encrypted according to operating system standards (iOS/Android), local data retention without transmission to external servers, processing only data strictly necessary for the functionality requested by the user. Cellularline is committed to taking appropriate technical and organizational measures to ensure the security of the App. However, the overall security of the data also depends on the protection measures taken by the user on their device (e.g. PIN, biometric access, device encryption, operating system updates, etc.).
